PRESERVING THE SPIRIT OF PANCASILA INDUSTRIAL RELATIONS IN THE ERA OF THE GIG ECONOMY

Abstract

The rapid advancement of technology has driven the emergence of the gig economy, characterized by flexible work arrangements, short-term contractual relationships, and minimal labor protection. This condition presents serious challenges to the sustainability of Pancasila Industrial Relations (HIP), which is grounded in the values of divinity, humanity, unity, democracy, and justice as reflected in Indonesia’s labor regulations. This study aims to analyze the impact of the gig economy on industrial relations in Indonesia and to formulate strategies to preserve the essence of HIP amid these changes. The research employs a normative juridical method using statutory, conceptual, and philosophical approaches, drawing on secondary data analyzed qualitatively. The findings indicate that the gig economy hinders the optimal functioning of employers, workers, and the government, particularly due to ambiguous employment status, the absence of career pathways, lack of social security, and weak legal protection for platform-based partner workers. These conditions contradict the objectives of HIP, which emphasize welfare and harmonious relations. The study concludes that strengthening both primary and secondary regulations with more detailed provisions, as well as reaffirming Pancasila’s values as a filter in responding to the dynamics of the gig economy, is essential to ensure worker protection and uphold the spirit of HIP in the era of digital economic transformation.
